Terms and Conditions

1. Purview
The following terms and conditions apply for all orders placed in our online-shop by consumers and businesses.

A consumer is every natural person that can perform a legal transaction, that is mostly non work-related, considering both an employed position and self-employment as work. A business is every natural person or legal entity or legal partnership that acts within the scope of its employed or self-employed work while concluding a legal transaction.

For all businesses these terms and conditions stay relevant for all future business relations without us repeatedly indicating them as such. If the business is making use of contradictive or additional terms and conditions, we hereby contradict these terms and conditions; they can only become part of the contract, if we explicitly agree to them.

2. Contractor, Contract Conclusion
The contract is agreed on with the SHATLER’s Getränke GmbH.

The depiction of the products in the online-shop is not a legally binding offer, but a non binding online catalog. You can put the products in the shopping basket without binding yourself and you can alter your input anytime by utilizing the correction options offered and explained during the ordering process before sending your binding order. By clicking the ordering-button you are sending a binding order of the products in your shopping basket. You will receive a confirmation of order via e-mail after sending your order.

When the contract is realized depends on your chosen payment method.

Invoice

We accept your order by sending a confirmation of order in a separate e-mail or by delivering the products within 2 days.

Advance Payment

We accept your order by sending a confirmation of order in a separate e-mail within 2 days in which we send you our bank account information. We will send the products after receiving the payment.

Credit Card

By sending the order you are also sending us your credit card information. After checking your legitimization as legal credit card owner we request the payment transaction from your credit card company and thereby accept your order.

PayPal

During the ordering process you will be forwarded to the online-service PayPal. There you can enter your payment data and confirm your payment with PayPal. After you send your order through our online-shop we will request the payment transaction from PayPal and thereby accept your order.

3. Language of Contract, Storage of the contract wording
The language of contract is German. We save the contract wording and send the order information and terms and conditions to you via e-mail. The terms and conditions can be reviewed on this page anytime. Your previous orders can’t be reviewed online due to safety reasons.

4. Terms of delivery
Adding to the indicated product prices, you also need to pay the shipping charges. You can review further information about the shipping charges at our online-shop info-center.

We ship only by shipping route. Unfortunately it is not possible to pick up the products. We do not deliver to a Packstation or a Paket Shop.

5. Payment
In our online-shop we offer the following payment options:

Advance payment

We accept your order by sending a confirmation of order in a separate e-mail within 2 days in which we send you our bank account information. We will send the products after receiving the payment.

Credit Card

By sending the order you are also sending us your credit card information. After checking your legitimization as legal credit card owner we request the payment transaction from your credit card company and thereby accept your order. There will be no additional cost for this method of payment.

PayPal

During the ordering process you will be forwarded to the online-service PayPal. To use PayPal you need to be registered/ register with PayPal, legitimize your account information and confirm the payment to us. There will be no additional cost for this method of payment.

Invoice

Sale on account is possible for registered businesses only.

6. Reservation of ownership
The products stay our property until we have received payment in full. The following additionally applies for businesses: We reserve the right of ownership of the goods until all due payments in the ongoing business relationship have been made in full. You may resell the goods under retention of title through your normal course of business operation; all due payments from the reselling will be transferred to us – independently from the goods being combined or mixed with other goods – in the full amount of invoice in advance and we accept the transfer of rights. You stay entitled to collect the payment, but we also gain entitlement to collect the due payments, if you don’t pay your amounts due.

7. Damage in transit
The following applies for consumers: If goods are delivered with apparent damages, please make a complaint with the carrier immediately and contact us as soon as possible. Failure to make a complaint or contact us immediately does not have a negative impact on your ability to enforce your legal rights, especially your warranty rights. You do however help us to enforce our claims opposite the shipping contractor or the transport insurance company respectively.

The following applies for businesses: The risk of accidental loss or accidental damage is transferred to you as soon as we hand over the goods to the shipping contractor, the carrier or a different person or institution hired for the delivery. Among merchants the duty to inspect and notify according with the German commercial code §377 applies. Failure to notify us accordingly translates to accepting the goods unless the defect was undetectable during the inspection. This does not apply if we maliciously concealed the defect.

8. Warranty and guarantees
Unless below explicitly otherwise specified, the statutory warranty rights apply. For consumers the period of limitation for warranty claims for used goods ends after one year, starting with the delivery of the goods.

For businesses the period of limitation for warranty claims ends after one year, starting with the passage of risk; this does not affect the statutory periods of limitation for the claim to recourse according to §478 of the German civil code. For businesses only the information provided by us and the product descriptions of the producer which were included in the contract are relevant to the agreement upon the state of the goods; we are not liable for public statements or advertisement claims made by the producer.

If the delivered good is defective, opposite a business we will choose to provide warranty either by elimination of the defect (rectification) or through the delivery of a good free of defects (replacement). The aforementioned restrictions and reductions of periods of limitation do not include claims due to defects caused by us, our legal representatives or vicarious agents

  • in case of injury of life, body or health
  • in case of intentional, grossly negligent or malicious breach of duty
  • in case of infringement of essential contractual obligations, the proper implementation of which is necessary for the fulfillment of the contract and in which the contracting partner may trust regularly (cardinal obligations)
  • within the scope of a guarantee, as agreed
  • within the purview of the lemon law

9. Liability
We are liable for claims due to defects caused by us, our legal representatives or vicarious agents

  • in case of injury of life, body or health
  • in case of intentional or grossly negligent breach of duty
  • within the scope of a guarantee, as agreed, or
  • within the purview of the lemon law

In case of infringement of essential contractual obligations, the proper implementation of which is necessary for the fulfillment of the contract and in which the contracting partner may trust regularly (cardinal obligations) due to ordinary negligence by us, our legal representatives or vicarious agents the liability is limited to the foreseeable damage which is usually caused, at the time of reaching agreement. Other claims for compensation are excluded.

11. Settlement of disagreements

We are willing to participate in an extrajudicial conciliation procedure before the consumer settlement office. 12. Protection of children and young persons
If your order includes products which are subject to a legal age limit, we use a reliable process, including a personal identity and age check, to enure the buyer has reached the required age limit. The carrier will deliver the order only after an age check and only to the buyer personally.

13. Final provision
German law, excluding UN-sales law, applies for all businesses.

If the buyer is a merchant in accordance with the German commercial code, a legal entity under public law or special fund under public law, the exclusive jurisdiction for all disagreements regarding contracts between you and us shall be our place of business. If these terms and conditions did somehow not become part of the contract or only partly became part of the contract or became ineffective, the contract stays valid. In case these terms and conditions did somehow not become part of the contract or only partly became part of the contract or became ineffective, the content of the contract is adjusted according to the usual legal regulations.
